Welcome to Ai Chat & Video-Roleplay ("App," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our mobile application and related services. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Acceptance of Terms
By accessing or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance of the updated Terms.
2. Description of Service
Ai Chat & Video-Roleplay provides AI-powered chat and video roleplay experiences. The App allows you to interact with AI-generated characters through text and video interfaces. All content generated by the AI is synthetic and does not represent real individuals, opinions, or factual information.
3. User Accounts
- You must provide accurate and complete registration information.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are solely responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized access or security breach.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use Policy
Prohibited Conduct: You agree NOT to use the App to:
- Generate, solicit, or distribute illegal content, including child sexual abuse material (CSAM), non-consensual intimate imagery, or content depicting real minors in sexual situations.
- Harass, bully, threaten, or impersonate any person or entity.
- Generate hate speech, discriminatory content, or content promoting violence.
- Attempt to reverse-engineer, decompile, or extract source code from the App or AI models.
- Use automated tools, bots, or scrapers to access the App.
- Circumvent security measures, payment systems, or content filters.
- Upload malware, viruses, or malicious code.
- Use the App for commercial purposes without written authorization.
- Interfere with or disrupt the App's infrastructure or other users' experiences.
Violation of this policy may result in immediate account termination without refund and potential legal action.
5. AI-Generated Content Disclaimer
- All responses, videos, images, and interactions are generated by artificial intelligence and are entirely fictional.
- AI characters do not have consciousness, emotions, or personal beliefs.
- AI-generated content may be inaccurate, incomplete, or inappropriate despite moderation efforts.
- You should not rely on AI-generated content for medical, legal, financial, or professional advice.
- We do not guarantee the accuracy, reliability, or suitability of any AI-generated content.
6. Intellectual Property
6.1 Our Rights
The App, including its code, design, AI models, branding, and original content, is owned by us and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes only.
6.2 User Content
You retain ownership of content you create using the App. However, by submitting or generating content, you grant us a worldwide, royalty-free license to process, store, and display such content solely to provide and improve the service. You represent that you have all necessary rights to any content you upload.
7. Subscriptions & In-App Purchases
- Premium subscriptions and in-app purchases are processed through Google Play Billing.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
- You can manage or cancel subscriptions through your Google Play account settings.
- All sales are final. Refunds are subject to Google Play's refund policy.
- We reserve the right to change pricing with reasonable notice. Price changes take effect at the next renewal cycle.
- Free trial periods convert to paid subscriptions automatically unless canceled before the trial ends.
8. Content Moderation & Safety
We employ automated and manual moderation systems to detect and remove prohibited content. However, no system is perfect. If you encounter violating content, please report it immediately via [email protected]. We reserve the right to remove any content and terminate any account at our sole discretion.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your violation of these Terms, misuse of the App, or infringement of third-party rights.
12. Termination
You may terminate your account at any time through the App settings. We may suspend or terminate your access immediately, without notice, if you violate these Terms. Upon termination, your right to use the App ceases, and we may delete your data in accordance with our Privacy Policy.
13. Governing Law & Dispute Resolution
These Terms shall be governed by applicable laws without regard to conflict of law principles. Any disputes shall first be attempted to be resolved through informal negotiation for 30 days. If unresolved, disputes shall be submitted to binding arbitration, except where prohibited by local law. Nothing in this section limits your statutory consumer rights.
14. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
